1. Sponsor

The An’s Gate D5 Grand Opening Giveaway (the “Promotion”) is sponsored solely by An’s Gate D5, a DBA of Sei Fratelli Gelato, Inc., 216 N. Pacific St., Oceanside, CA 92054 (“Sponsor”). Mission Pacific Beach Resort is the prize provider/fulfillment venue only and is not a sponsor.

2. Eligibility

Open only to legal residents of California who are 18 years of age or older at the time of entry. Owners, officers, directors, and employees of Sponsor, and each of their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they live) and persons living in the same household, whether related or not, are not eligible. The Promotion is subject to all applicable laws and is void where prohibited.

3. Promotion Period

The Promotion begins September 5, 2026 and ends September 12, 2026 at 12:00 p.m. Pacific Time (“Promotion Period”). Sponsor’s systems are the official timekeeping device. Entries received after the close are not eligible.

4. How to Enter

During the Promotion Period, visit https://flyansgelato.com/join-boarding-list/ directly or through an authorized Promotion QR code and submit the requested information to join the An’s Gate D5 email list (“Boarding List”). No purchase is necessary. Limit one entry per person, regardless of the number of submissions, email addresses, devices, or entry paths used.

Individuals already subscribed to the Gate D5 Boarding List when the Promotion begins are automatically entered, provided they remain subscribed through the end of the Promotion Period and otherwise satisfy these Official Rules. Resubmitting the form may be used to confirm list status, but does not create an additional entry. Automated, bulk, incomplete, inaccurate, fraudulent, or otherwise noncompliant entries are void. Sponsor may disqualify any entrant who tampers with the entry process or attempts to obtain more than one entry.

5. Prize, Approximate Retail Value, and Exclusions

One (1) winner will receive one (1) night in a standard room at Mission Pacific Beach Resort in Oceanside, California, based on single or double occupancy unless otherwise approved by the hotel in writing. The prize includes the daily room rate, applicable room taxes, mandatory hotel or resort fees, and valet parking for one (1) vehicle. The approximate retail value (“ARV”) of the prize is $600.

Except for complimentary valet parking for one (1) vehicle, the prize does not include additional parking, transportation, food or beverages, incidentals, gratuities, upgrades, additional guests, damages, smoking or cleaning fees, late-checkout charges, or any other expense not expressly identified as included. The winner is solely responsible for all excluded expenses. The hotel may require a valid credit card or deposit at check-in to cover incidentals and other charges not included in the prize.

The prize stay is subject to room availability, blackout dates, seasonal restrictions, special events, occupancy levels, and other operational limitations determined by Mission Pacific Beach Resort in its reasonable discretion. Availability of rooms offered for sale to the general public does not guarantee availability for prize redemption. Requested dates are not guaranteed, and the winner may be required to select alternate dates. Blackout dates include all major holidays and summer peak days, as determined by Mission Pacific Beach Resort.

The winner must book the stay sufficiently in advance and follow the booking and redemption instructions provided by Sponsor or Mission Pacific Beach Resort. Sponsor will coordinate the initial introduction and handoff to the hotel after the winner has been verified. The winner should not contact the hotel regarding redemption until instructed to do so. Following Sponsor’s instructions and receipt of the prize certificate, the winner must make the reservation directly with Mission Pacific Beach Resort by calling 760-512-3600 or emailing sando.reservations@destinationhotels.com. The hotel may require the winner to present the original prize certificate or redemption code, valid government-issued identification, a valid credit card, and any other documentation reasonably required at the time of booking or check-in.

The certificate expires September 11, 2027, and the stay must be booked and completed no later than that date. The certificate may not be extended or reissued. The winner must satisfy the hotel’s standard minimum check-in age and comply with all generally applicable reservation, check-in, occupancy, guest-conduct, security, health and safety, and property policies in effect at the time of booking and the stay.

Once confirmed, the reservation is subject to the hotel’s standard cancellation, modification, and no-show policies. Failure to arrive for a confirmed reservation, cancellation after an applicable deadline, failure to satisfy check-in requirements, or conduct that violates hotel policies may result in forfeiture of the prize without replacement or compensation.

Mission Pacific Beach Resort may refuse, cancel, reschedule, modify, or terminate a reservation when reasonably necessary because of circumstances beyond its control or to protect guests, employees, property, or hotel operations, including severe weather, natural disaster, fire, public-health conditions, governmental action, labor disruption, utility or systems failure, property damage, safety or security concerns, overselling, closure, renovation, or another force majeure or operational event. When reasonably practicable, Sponsor and the hotel may offer alternate dates or a reasonably comparable accommodation or benefit, subject to availability. No cash refund, reimbursement, or additional compensation will be provided for a change, cancellation, or inability to use the prize, except as required by applicable law.

The prize certificate carries no cash value, is nontransferable, and may not be assigned, sold, bartered, substituted, or redeemed for cash. Sponsor may substitute a prize of equal or greater value if the advertised prize becomes unavailable for reasons beyond Sponsor’s reasonable control. Any difference between the stated ARV and the prize’s actual value will not be awarded. Failure to book or complete the stay by the applicable deadline will result in forfeiture without compensation.

Mission Pacific Beach Resort is the prize provider and redemption venue only. It is not responsible for administering the Promotion, selecting or verifying the winner, communicating with entrants, or ensuring Sponsor’s compliance with these Official Rules or applicable law. The hotel’s interpretation and application of its generally applicable booking and property policies will control with respect to the reservation and stay, subject to applicable law. Any use of the hotel’s name, trademarks, logos, photographs, or other brand materials is subject to the hotel’s prior approval and applicable brand guidelines.

6. Odds

Odds of winning depend on the number of eligible entries received during the Promotion Period.

7. Random Drawing and Winner Notification

Sponsor will conduct a random drawing from all eligible entries after 12:00 p.m. Pacific Time on September 12, 2026. The potential winner will be notified at the email address associated with the selected entry and must respond within 48 hours of the time the notification is sent. Entrants are responsible for monitoring their inbox and spam/junk folders.

The potential winner may be required to confirm eligibility and compliance with these Official Rules and to provide any information reasonably necessary to fulfill the prize. If a potential winner is ineligible, fails to respond within 48 hours, declines the prize, cannot be contacted, or fails to satisfy a required verification, the prize may be forfeited and Sponsor may select an alternate potential winner by random drawing from the remaining eligible entries.

8. Prize Fulfillment

After verification, Sponsor will provide the prize certificate and coordinate the initial winner handoff. Following Sponsor’s instructions, the winner must make the reservation directly with Mission Pacific Beach Resort using the telephone number or confirmed reservations email address stated in Section 5. Sponsor is not responsible for the winner’s inability to travel, obtain transportation, satisfy hotel check-in requirements, or use the prize within the permitted period.

9. Publicity and Privacy

Except where prohibited, acceptance of the prize permits Sponsor to identify the winner by first name and last initial, city of residence, and/or a limited winner announcement in connection with the Promotion, without additional compensation. No broader use of the winner’s name, image, likeness, voice, biography, or statements is granted without separate consent.

Entry information will be used to administer the Promotion and, because entry is made by joining the Boarding List, to send An’s Gate D5 email communications. Entrants may unsubscribe from marketing emails at any time; however, an existing subscriber must remain subscribed through the close of the Promotion Period to retain the automatic entry described above. Sponsor will otherwise handle personal information in accordance with its applicable privacy practices.

10. General Conditions

Sponsor reserves the right to cancel, suspend, modify, or terminate the Promotion if fraud, technical failure, unauthorized intervention, force majeure, or another cause beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion. If feasible, Sponsor may award the prize by random drawing from eligible, non-suspect entries received before the action. Sponsor’s decisions regarding eligibility, administration, and interpretation of these Official Rules are final, subject to applicable law.

Sponsor is not responsible for lost, late, incomplete, inaccurate, misdirected, delayed, corrupted, or undelivered entries or communications; unavailable networks, websites, QR codes, servers, email systems, or devices; typographical or printing errors; or unauthorized human intervention, except to the extent liability cannot lawfully be excluded. If a dispute arises over the identity of an entrant, the authorized account holder of the email address used to enter will be deemed the entrant, subject to verification.

11. Release and Limitation of Liability

To the fullest extent permitted by law, entrants agree to release and hold harmless Sponsor and its officers, directors, employees, and agents from claims arising out of participation in the Promotion or acceptance, possession, use, misuse, or redemption of the prize. Nothing in these Official Rules limits liability that cannot be limited or excluded under applicable law. Mission Pacific Beach Resort and its owners, operators, affiliates, and personnel are not responsible for Sponsor’s administration of the Promotion.

12. Disputes and Governing Law

The Promotion and these Official Rules are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute shall be brought individually, and not as part of a class action, in a court of competent jurisdiction in San Diego County, California, except where applicable law requires otherwise. Entrants waive claims for punitive, incidental, or consequential damages to the extent permitted by law.

13. Instagram / Meta Disclaimer

This Promotion is not sponsored, endorsed, administered by, or associated with Instagram or Meta. By entering, each entrant releases Instagram and Meta from claims arising out of the Promotion to the extent permitted by law.
